Terms & Conditions of Sale
All our Products made by us are subject to the following Terms and Conditions.
Quotations
All Quotations are valid for 7 days from the date of issue.
Orders
We prefer at least fourteen (14) days notice for all orders, as we are continually booked in advance. We will however endeavour, where availability permits accept short notice cakes.
Short notice cakes
Cake orders placed 7 days before delivery are considered short notice cakes and are accepted at the discretion of Mrs H’s Cakes – depending on existing commitments. As these cakes require last minute planning and may require ordering supplies not currently in stock, these cakes are subject to a short notice order charge. In some cases, this may be in addition to further delivery charges incurred from next day delivery services. These charges will be made clear at the point of order. The short notice order charges are as follows:
7 days or less before collection/delivery date = +25% of the cost of the base price of the cake (before secondary decorations)
2 days or less before collection/delivery date = + 50% of the cost of the base price of the cake (before secondary decorations)
Design
Any Products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.
Payment
You agree to pay the company (Mrs H’s Cakes) the full amount as quoted on your signed Order Form. Payment methods accepted are Cash or Bank Transfer.
Bookings & Deposits
All orders and booking dates are only secured with a non-refundable deposit. Once deposits are received and cleared, your booking date will be fully secured.
i. Wedding cakes: A deposit of 25% is required to confirm order and contract for the described services. The remaining balance will be due four weeks before delivery/collection.
ii. Other celebration cakes: A deposit of 25% is required to confirm order and contract for the described services. The remaining balance will be due twoweeks before delivery/collection. Short notice orders, placed within two weeks of delivery/collection must be paid for in full at time of booking.
iii. Cupcakes:Full payment due at time of booking
Any changes to an order must be made at least four weeks prior to delivery/collection.
Late & Non-payments
Late payments could result in loss of your booking date. Failure to make payment may result in your order being cancelled. In the event of a late or non-payment, the order will not proceed until alternative funding has been agreed and payment made in full.
Cancellations:
i. Wedding cakes: Over 4 weeks: 25% of the total cost (as the deposit) will be retained. Less than 4 weeks: 100% of total cost payable.
ii. Other celebration cakes: Over 2 weeks: 25% of the total cost (as the deposit) will be retained. Less than 2 weeks: 100% of total cost payable.
Refunds will be paid within 30 days of cancellation.
Change of wedding date
If for any reason, you wish to re-arrange the date of your wedding/order, we will try our best to accommodate these changes without any additional charges, provided sufficient notice is given and that we are able to provide a cake for the re-arranged date. However, if we are fully booked on your new wedding date and cannot provide the wedding cake, it will not be possible to refund your deposit.
Collections
After collection, it is the Cake Customer’s responsibility to ensure the safety of the cake until it’s required destination. The Cake Decorator cannot be held liable for any damage to the cake after it has been collected. On the day of collection your order may be collected at a pre-arranged time, as agreed on the order form. Should you wish to change the collection details, we will do our best to accommodate, but cannot guarantee availability.
Deliveries
We offer delivery for certain destinations. Delivery is charged at our discretion
We will deliver at the time and address agreed with the customer on the order form. If we can’t deliver because there is no-one to receive the cake or the address provided is wrong, the cake will return to our business address and will be held for a maximum of 24 hours. Delivered cakes should be inspected upon receipt as the Cake Decorator cannot be held liable for any damage which occurs after the delivery and/or as a result of failure to follow any instructions/advice we may give in respect of storage or setting up or of further transportation of the cake.
Flowers
If fresh flowers will be placed on the cake by a 3rd party, it is the responsibility of the 3rd party to determine flower safety and safe food practices and not the cake decorator.
Allergies
It is the responsibility of the Cake Customer advise the Cake Decorator of any known allergies to any ingredients that may be used in the cakes. Unless otherwise agreed -cake ingredients or machinery may come in contact with nuts, milk, and wheat products. Allergen information is provided with all orders.
Unforeseen circumstances
In the very unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative Cake Decorator. We will make every effort to secure a replacement cake designer. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event.
Publication
We reserve the right to use any image of a Product made by us for publication at a later date.
